- These Terms and Conditions (“Terms”) govern the use of financial services offered by Kulman Group Limited (“Kulman”, “we”, “us”, or “our”) to employees of partner organizations (“you” or “the user”). By accessing or using Kulman’s services, you confirm that you have read, understood, and agree to be bound by these Terms.
- These Terms apply to all Kulman Group financial solutions, including but not limited to: Jipange Emergency Advance, Jipange School Fees, Jipange Maisha, Jipange Boda and Auto, Jipange Retirement, and Jipange Bespoken. Kulman services are only accessible to employees of organizations that have signed a Memorandum of Understanding (MoU) with us. These Terms apply solely to individual employees. Client organizations are governed separately by their respective MoUs.
- To be eligible for Kulman services, you must be actively employed by an organization that has signed a MoU with Kulman Group, and your employment data must be submitted to Kulman by your HR department. Services are accessed through USSD, our web application, or our mobile application (where available).
- You are expected to use Kulman services honestly and responsibly. Any form of fraud, misrepresentation, or abuse of the platform is strictly prohibited. If your employer fails to make the required deductions or remittances to us, your access to Kulman services may be suspended.
- Each Kulman product carries specific terms including interest rates, repayment periods, disbursal fees, and borrowing limits. These are clearly communicated before you apply for any facility. Repayment is done exclusively through payroll deductions. If you leave your employment while having an outstanding balance, any amounts due will be recovered from your terminal dues. If there remains a balance after this, you are obligated to repay Kulman directly.
- If payroll deductions fail, are incomplete, or are not remitted by your employer, your access to Kulman services may be restricted until the outstanding amount is settled. Kulman does not charge any hidden or optional fees. Fees are limited to a disbursal fee and a simple interest charge based on the applicable product.
- By accessing the Kulman system through any of its available channels (i.e. USSD, Mobile application, ETC.) you consent to provide your confidential data for the purpose of conducting research, provision of services, or fulfilling contractual obligations, risk assessments, product availability, or any other internal usage needed to deliver services to end users.
- Additionally, by accessing the Kulman system through any channel including USSD, mobile app, web app, or any other platform, you expressly consent to the use of Kulman services and agree to the terms herein. Kulman acts as both a data controller and data processor. We may share data with trusted third parties such as our system provider, debt collection partners, and others necessary for service provision.
- Users cannot terminate their access to Kulman services independently. Kulman reserves the right to suspend or terminate user access at its sole discretion in cases of misuse, fraud, or breach of these Terms.
- Kulman shall not be held liable for delays, disruptions, or failures resulting from system outages, payroll errors by employers, or other external factors beyond our control.
- These Terms are governed by the laws of Kenya. Any disputes arising from the use of our services shall be resolved through arbitration or the courts, at Kulman’s discretion.
- We may communicate with you via SMS, WhatsApp, email, employer channels, or through our USSD and web platforms. You are expected to receive such communication through any channel we choose. It is the responsibility of your employer to keep your contact information current in our system.
- Kulman may revise these Terms at any time. Updates will be communicated via SMS. Your continued use of our services constitutes acceptance of any updated terms.
